Artistic associations and creative individuals
The Creative Persons and Artistic Associations Act was adopted on 18 November 2004 and its purpose is to support cultural creativity and the preservation and development of the fine arts at the professional level and to improve the necessary conditions and guarantees for the creative activity of creative individuals through artistic associations.
ARTISTIC ASSOCIATION
An artistic association is a non-profit association the purpose of which is to promote one artistic field and support the creative activities of individuals who are members of the artistic association.
Creative individuals engaged in one artistic field are united and represented by an artistic association. Professional creative associations may be created separately in one artistic field. Up to 40 per cent of the members of the artistic association may belong to the membership of another artistic association recognised in the same artistic field.
An artistic association must comprise at least 50 natural persons with active legal capacity who have been engaged in creative activities in the corresponding artistic field at least for the last three years and whose works have been published during the period or directed at the general public within the meaning of sections 9 and 10 of the Copyright Act.
The statutory objective of an artistic association and the profession of the individuals acting therein, who are united and represented by the artistic association, may not coincide with the statutory objective and professional field of another artistic association recognised in the same field. An artistic association may not establish regional, ethnic, gender, racial or other restrictions which do not arise from the artistic or professional field.
CREATIVE PERSON
A creative person may be a member of several artistic associations at the same time. A creative person is an author or performer within the meaning of the Copyright Act who acts in the field of architecture, audio-visual arts, design, performing arts, sound arts, literature, visual arts or scenography.
CREATIVE PERSON ENGAGED IN LIBERAL PROFESSION
According to the Creative Persons and Artistic Associations Act, a creative person engaged in a liberal profession (i.e. engaged as a freelancer) is someone whose main source of subsistence is professional creative activity in the field of architecture, audio-visual arts, design, performing arts, sound arts, literature, visual arts or scenography and who does not work under an employment contract or other similar contract under the law of obligations.
